Licensure Laws
Forty-one states have laws that regulate the profession of dietetics and nutrition. The regulations fall into the following categories: licensure; statutory certification; or registration. These terms are defined as:Licensure - statues include an explicitly defined scope of practice, and performance of the profession (nutrition / weight management) is illegal without first obtaining a license from the state. Hence it is illegal to provide nutrition or weight management in these states without a license. There is a provision, however, that allows a person to provide weight control services provided the program is monitored by a licensed professional and provided the program does not change.
Statutory Certification - limits use of particular titles to persons meeting predetermined requirements, while persons not certified can still practice the occupation or profession. Individuals in these states may provide weight management and nutrition services without being licensed; however, individuals may not use the term dietitian or licensed dietitian without adequate credentials.
Registration - is the least restrictive form of state regulation. Unregistered persons are permitted to practice the profession. Individuals in these states may provide weight management and nutrition services without being licensed.
While some states allow non-licensed professionals to provide weight management and nutrition services, it is not recommended - for ethical and legal reasons. All allied health professionals should consult with a licensed dietitian/nutritionist before beginning a weight management program.
